Yet for many, Guatemala is still synonymous with war, sociopolitical instability, and more or less rampant corruption, coupled with crime and money laundering. This reputation is partly deserved and partly an unfair remnant of a troubled past.

Taxation and Territorial Taxation in Guatemala

Guatemala applies territorial taxation: only income generated within Guatemalan territory is subject to tax. Foreign-source income is not taxed, making the country particularly attractive to digital nomads, freelancers, and entrepreneurs with international operations. The corporate income tax (ISR) is divided into two regimes: the Régimen Sobre Utilidades at 25% on net profits, or the Régimen Sobre Ingresos (Income , with progressive rates of 5% up to Q30,000 and 7% above that threshold. The standard VAT rate is 12%, among the lowest in Latin America.

For small taxpayers with annual revenues of less than Q465,381 (approximately USD 60,000), the Small Taxpayer Regime (Régimen de Pequeño Contribuyente, which provides for a flat 4% tax on gross sales. Guatemala does not have a double tax treaty with Italy, but territorial taxation makes this aspect less relevant for those who operate exclusively with foreign income.

How to obtain residency in Guatemala

Residency in Guatemala – Studio Panama Italia

The process for obtaining residency in Guatemala is multi-stage, managed by theGuatemalan Migration Institute (IGM) through the Sub-Directorate of Foreigners. Since 2025, with the entry into force of the new Guatemalan Residency Agreement (Acuerdo IGM-016-2025), the procedures have been updated and simplified in several respects, while maintaining the requirement of a Guatemalan guarantor.

Phase 1: 90-day residence permit

To apply for a 90-day residence permit at the IGM, the applicant must provide:

  • photographs passport-sized
  • Valid passport with at least 6 months validity
  • Sponsorship letter from a Guatemalan guarantor (natural or legal person)
  • Proof of financial resources of both the applicant and the sponsor
  • Proof of payment of the consular fee

This visa is generally issued fifteen days after the application is submitted. The Guatemalan guarantor cannot simultaneously act as guarantor for more than three people, except for family members.

Phase 2: Ordinary Visa Application

Before the 90-day residence permit expires, the prospective resident must apply for an Ordinary Visa, which allows residency in Guatemala for six months and is renewable. The applicant must present:

  • Birth certificate authenticated by the Guatemalan Consulate in Italy

While awaiting approval for the Ordinary Visa, the applicant can work if the permit is granted by the Ministry of Labor in Guatemala City. According to Guatemalan immigration authorities, processing the Ordinary Visa takes up to two months, during which time the immigration office retains only a validated photocopy of the passport.

Phase 3: Ordinary Visa Extensions and Temporary Residence

The ordinary visa can be extended in six-month increments. Upon expiration of the fourth extension, or after approximately two years of residency under the ordinary visa, the applicant may qualify for temporary residency, which, starting in 2025, will be granted for a period of one to five years, as determined by the IGM.

UPDATE 2025 — Agreement IGM-016-2025: Guatemala has updated its Guatemalan Residency Regulations. Temporary residency can now be granted for 1 to 5 years. After 5 years of temporary residency, permanent residency can be requested pursuant to Article 78 of the Migration Code. Legal entity guarantors no longer require fiscal solvency or financial statements. Expedientes inactive for 6 months are archived.

Phase 4: Permanent Residency

After at least 5 years of continuous temporary residence, the applicant can apply for permanent residence, which provides stability and greater opportunities in the country, allowing residents to fully integrate into the economic and social life of Guatemala.

The Foreigners' Office at the IGM headquarters also issues other types of visas to foreigners:

  • Student visa: valid for one year, mandatory for elementary, high school, and university students. May be extended for the duration of studies.
  • Courtesy visa: valid for one year, issued to members of the diplomatic community.
  • Temporary Visas: issued for 12 months to foreign teachers or students.
  • Religious Worker Visas: Valid for two years.
  • Simple Visa: Allows a single entry and exit from the country. Valid for 6 to 12 months.
  • Multiple Visa: Allows unlimited entries and exits. Valid for 1 to 5 years.
Important note: From 2025, a valid passport certificate and a return ticket are no longer required for category C visas. Submitting a visa application does not oblige the IGM to issue it, and the institute reserves the right to request additional documentation or arrange an interview.

What is life like in Guatemala?

Guatemala is the most populous country in Central America, with nearly 17 million inhabitants. It offers extraordinary cultural and landscape diversity: from the colonial city of Antigua Guatemala to the Mayan sites of Tikal, from Lake Atitlán to the Caribbean coast. The climate is temperate in the highlands (where the capital is located at 1,500 meters above sea level), tropical along the coast and in the Petén region.

The cost of living is significantly lower than in Mexico and Costa Rica. The minimum wage in 2026 for non-agricultural activities in the economic district of the Department of Guatemala is Q4,002 per month (approximately USD 520), plus an incentive bonus of Q250. The basic extended wage is around Q2,233 per month. For a European, living in Guatemala on a budget of USD 1,200–1,800 per month allows for a comfortable lifestyle, especially in the cities of Antigua, Quetzaltenango, or in Zone 10 of the capital.

The Italian community in Guatemala is small but present. Cultural proximity to the Hispanic world facilitates adaptation. Foreigners who decide to settle in the country generally find a welcoming social fabric, especially in areas with a strong international tourist presence.

Security in Guatemala

Guatemala has made significant progress in safety in recent years, but it remains a country that requires attention. Tourist and residential areas in major cities are reasonably safe, while some peripheral and rural areas still present challenges. Incorporation in Guatemala can be time-consuming. While theoretically, incorporating a company can be completed in a few days, in practice the process can take several weeks. Incorporation costs are generally higher than in Panama and Uruguay due to the complex bureaucracy and lack of competition in the legal services sector.

To establish an LLC in Guatemala, the following requirements must be met:
